All dram shop plaintiffs are either: (a) intoxicated patrons who claim that because they were overserved, they lacked the capacity to avoid the accident; or (b) third-parties (who may or may or not be innocent) who claim that an intoxicated patron injured them. Whether there is evidence of visible intoxication is the dispositive issue in the case.
Our focus in defending these cases – be it a drunk driving car crash, a fatality or a sexual assault case – is a focus on the facts. This means working with our network of trained investigators to make sure we find out what the witnesses know before the plaintiffs do. That knowledge might be good, it might be bad, it might even be indifferent, but knowing the facts makes all the difference in getting the best possible result.
